These Terms & Conditions (“Terms”) apply to everyone who uses our services, platforms, and website or provides information to us (“you” or “your”). By accessing our website, booking a consultation, or otherwise using our services, you agree to these Terms, our Privacy Policy, and any other agreements we present to you.

By accessing or using this Site and our services, you confirm that you have read, understood, and agree to be bound by these Terms at all times. If you do not agree with these Terms, you must not use the Site or our services.

Definitions

  • “Medicine” – Any medicinal cannabis or related products prescribed by an authorised healthcare practitioner.

  • “Pharmacy” – Any pharmacy or authorised supplier engaged to dispense medicinal cannabis in accordance with Australian law.

  • “Services” – All services provided by Branch-Out Wellness, including the telehealth platform, booking system, and any other patient support services described herein.

  • “Clinic Services” – Services delivered by qualified healthcare practitioners, including telehealth consultations, follow-up appointments, and related care.

  • “Platform” – The Branch-Out Wellness website and any associated digital platforms or systems we use to provide services.

  • “Staff” – Employees or contractors engaged by Branch-Out Wellness to deliver or facilitate services.

  • “Healthcare Practitioners” – Medical professionals engaged through our platform, including medical practitioners, registered nurses, and nurse practitioners.

  • “Fee” – Any fees payable for consultations, services, or other features offered by Branch-Out Wellness.

Medical Disclaimer

  1. Branch-Out Wellness provides medical consultations via telehealth in compliance with applicable Australian laws and regulations.
  2. All medical advice, prescriptions, and treatment recommendations are made at the sole professional discretion of our registered healthcare practitioners.
  3. The information provided on this Site is for general informational purposes only and does not constitute medical advice. You should not rely on this Site as a substitute for professional medical advice, diagnosis, or treatment.
  4. Eligibility for natural health solution is determined strictly by a qualified practitioner and in accordance with the Therapeutic Goods Administration (TGA) requirements.

Our Services

Branch-Out Wellness provides a platform to facilitate:

  1. Initial and follow-up consultations with healthcare practitioners.
  2. Assessments of patient eligibility for medicinal cannabis.
  3. Secure issuance of medical documents and prescriptions when clinically appropriate.

Connecting patients with licensed Australian pharmacies for the supply and delivery of prescribed medicine.

Important Notes about our Services:

  1. All prescriptions are issued at the sole discretion of your healthcare practitioner and only where medically appropriate.
  2. We do not guarantee that your consultation will result in a prescription.
  3. Branch-Out Wellness does not sell or deliver prescribed medicine.

     

Telehealth Consultations and Prescriptions

  1. Consultations are conducted by authorised healthcare practitioners via telehealth consultations.
  2. By booking a telehealth consultation, you consent to the use of electronic communications and technology to deliver healthcare services.
  3. You acknowledge the potential limitations of telehealth, including interruptions, technical issues, or incomplete data transmission.
  4. It is your responsibility to ensure you have a private, safe, and reliable internet connection during consultations.
  5. Prescriptions are issued only when clinically appropriate under the Therapeutic Goods Administration (TGA) framework.
  6. Healthcare practitioners may require additional documentation before issuing prescriptions.
  7. Branch-Out Wellness makes no guarantees about treatment outcomes.

Pharmacy Facilitation

Branch-Out Wellness facilitates your connection with authorised Australian pharmacies to supply prescribed medicine.
  1. We do not operate as a pharmacy or sell or deliver prescribed medicine ourselves.
  2. Prescriptions are shared securely with authorised pharmacies to enable dispensing and delivery.
  3. Any purchase, payment, and delivery arrangements with pharmacies are your responsibility.

No Emergency or Urgent Care Services

Branch-Out Wellness is not an emergency medical service. Our services are not suitable for conditions requiring urgent or immediate medical attention.

If you require urgent medical care, call 000 or go to the nearest hospital emergency department.

If our staff reasonably believe there is an immediate risk to your safety or the safety of others, we may notify emergency services.

Use of Site and Services

  1. You agree to use the Site and our telehealth services only for lawful purposes and in accordance with these Terms.
  2. You must not use the Site to:
    • Provide false, misleading, or incomplete information;
    • Attempt to interfere with or compromise the security or functionality of the Site;
    • Access services for anyone other than yourself without proper authority.
    • Obtain prescriptions or medications through deception or fraud.
    • Abuse, harass, or threaten our staff, practitioners, or partners.
  3. We reserve the right to refuse service or terminate access if misuse is suspected.

Eligibility

Our services are available only to individuals who:
  1. Are 18 years or older.
  2. Are currently residing in Australia with a valid Australian residential address.
  3. Are using the services for themselves unless legally authorised to act on someone else’s behalf.
  4. Have the legal right and capacity to agree to these Terms.

Privacy and Data Usage

Branch-Out Wellness complies with the Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs).

We collect, store, and process your personal information to deliver our services, and will only be disclosed in accordance with applicable privacy and health laws.

By using our platform, you consent to:

  1. Sharing your personal and medical information with healthcare practitioners and authorised pharmacies where necessary.
  2. Securely storing your health information in accordance with applicable Australian laws.
  3. Allowing us to communicate with you via email, SMS, or phone regarding your consultations and services.

Payments and Fees

  1. Fees cover consultations only and do not include the cost of prescribed medicine.
  2. Branch-Out Wellness reserves the right to amend consultation fees at any time.
  3. Refunds are provided only if:
  • Your appointment is cancelled by us and cannot be rescheduled within a reasonable timeframe; or
  • The healthcare practitioner determines, before the consultation begins, that services are inappropriate for your circumstances.

No refunds are provided for change-of-mind cancellations.

Amendments to Terms

We may amend these Terms from time to time to remain compliant with laws and to reflect changes to the way we operate our Site and the way we expect users to behave on our Site. Updates will be posted on this Site, and, where appropriate, we will notify users by email. Your continued use of the Site constitutes acceptance of the revised Terms.

Termination of Services

We may suspend or terminate your access to our services if you:

  1. Breach these Terms.
  2. Provide false or misleading information.
  3. Use our platform for any unlawful or prohibited purpose.

Intellectual Property

All content published and made available on our Site, including but not limited to images, text, logos, branding, documents, graphics, videos, software, materials, and downloadable files, is the property of Branch-Out Wellness and its licensors.   2. We are not responsible for any adverse effects caused by prescribed medicine or third-party pharmacy services.

Nothing in these Terms excludes your rights under the Australian Consumer Law (ACL).

Indemnity

You agree to indemnify and hold harmless Branch-Out Wellness, including our directors, officers, employees, contractors, agents, subsidiaries, and affiliates, from any claims, actions, damages, liabilities, costs, or expenses (including legal fees) arising from your:

  1. Use or misuse of the Site or our services;
  2. Violation of these Terms;
  3. Breach of any applicable law or regulation.

Severability

If any provision of these Terms is found to be invalid or unenforceable under applicable law, that provision shall be deemed severed and will not affect the validity or enforceability of the remaining provisions.

Governing Law

These Terms are governed by the laws of the State of Queensland Australia, and any disputes shall be subject to the exclusive jurisdiction of the courts of Queensland Australia.
